    Default Morton Michel Contracts

    Hi, Can someone please tell me I have MM contracts I changed from NCMA on these ones it said on them that you cannot terminate contract during parent and childminder holidays is this the same with MM, as I have mindee on a term time conract only as I cannot seem to find it on these contracts.

    MM do not put the same restrictions on their contracts as the NCMA ones.

    You can use your own terms and conditions much more freely with MM.

    Think about what you want it to say and write it into your fees policy.

    I have not wrote anything on the morton michel contracts are on my fees only late payments, I fly to Spain in morning for 2 weeks parents have all paid me but one parent just been to pay and said she would like to terminate contract but Ive just told her she cannot terminate contract while I'm away on holiday and I need it in writing and need to be give 2 weeks notice she said that was fine then she said is it in contract that I cannot terminate while you are away

    That's the problem - if it's not in your policy or contract then you can't force them to pay.

    Hi Sarah, Just checked my Policies and Procedures folder and I have it in there about Termination of Contract,

    I have it wrote in this is what it say's

    2 weeks notice to be given from me or you the parent. This should be given in writing and should not be given during a period of the registered childminder's time off and when you the parent is on holiday are any other reason. During the notice period my childminding services will still be available.

    The parent signs and date the form I give them when they have read and understood my Policies and Procedures.

    So will this be ok if the parent as a dispute

    Has the parent signed anywhere to say it has been read and understood?

    If yes then it is legally binding... if no then you are unlikely to be able to use it if you need to make a claim.

    Yes she as signed the form and dated it to say she as read and understood the policies and procedures I photo copy this and all permission forms I keep the original ones and I give the photo copies to parents, I keep the originals in the childs folder with there contract.

    I started producing my own contracts a few years ago as I found it easier to be quite specific on certain issues.
