    Default They won't let me Childmind...



    So the Directors (freeholders) had their meeting on Monday night, I didn't hear anything from them at all. I have just gone round to one of the Directors that lives in one of the flats to ask how the meeting went. She's normally quite nice and she was the one who said why are you asking mefor permission? It's no different from you looking after your own children.

    Anyway, she was quite odd with me and just said 'no, they said no, it's against your lease, it's a business.' (although before she had said it's more a service.

    So that's it, I'm not allowed to childmind in my own home! I've always wanted to do it, I've done all my policies and all my permission forms, I've got my 1st meeting next saturday booked. I'm in tears, the other reason i wanted to start was because me & my dp want to try for a family soon so I would have been able to stay at home with our baby and make money at the same time....now we're well and truely F*****! (sorry for the language!) I'm so upset, I don't know if there is anything else i can do????

    So, I'll be disappearing from this forum, thanks for all your help everyone and support.

    Sorry to hear that.

    I don't know what to say other than have a word with Citizen's Advice but if your lease says no business then I don't think there's much you can do.

    It might be worth gathering some evidence together to show how you will be restricted in your numbers and it will only be for set hours, perhaps other residents would write you a letter of support - then you could approach the directors again.

    There may be a way round all this

    aww hunny that is awful, I am so sorry. is there no chance of appeal, meeting with the directors, can you approach your early years team to see if they can speak on your behalf?

    how about teaming up with another minder and working together (from her home?)

    OMG Snowbunny, i cant believe theyve said that its no different to you having your own children

    Can you appeal anyway? Can you go to you meeting next sat and ask for their help? Just trying to come up with some ideas...... Hopefully someone else will come up with some more

    I am so sorry to hear that you're not allowed to childmind from your home . Do you have any friends who are childminders (or planning to be childminders) who you could work together with from their home?

    I'm so sorry to hear your news. I've never heard of anything like this in all my years as a minder. Who can you go to? CAB, a solicitor, there must be someone. As Pip said, you early years team? Don't give up yet and don't leave the forum unless it upsets you. Let us know how you get on if you decide to persue it?

    we are in shared ownership and it does state in our contract about not running a business from home but I got the all clear from the planning dept 1st this is what they said:


    Thank you for your email dated 21st July 2008 regarding the possibility
    of carrying out child minding from the above property.

    Child minding does not constitute a material change of use when looking
    after up to 6 children, including any of your own. If you were looking
    after more than this number, you would require formal planning consent
    for a material change of use.

    I must stress that the comments made in this email are offered on an
    informal basis only and do not constitute a formal determination under
    Section 192 of the Town and Country Planning Act 1990. Nevertheless, I
    trust this information is useful to you.


    I would contact the planning office and see what they say, Moat have approved for me to be childminding

    Thanks for your support ladies much appreciated. We are going to appeal, I'm more angry than anything!! lol.

    sskent08 - does this mean the planning dept are saying looking up to 6 children doesn't make it a business? Sorry - I'm not understanding the 'material change' etc but thanks because my DP is now drafting a letter to the planning dept AND ALL residents of our flats. I's only be able to look after a MAX of 3 anyway i think so if this doesn't constitute as a business I'd love to stick to fingers up at the freeholders and management company

    hi there

    just wanted to say that I live in a rented property and it states in my lease that I cannot run a business from home. But I asked for and was grantd permission to childmind in my home and although it is technically a business, it is different.

    Thanks Ladies, I hope that it works out too.

    Apparently some parts of local government don't see minding under 6 children a business......so technically I could say looking after 3 isn't a business. I'm writing letters after letters and calling people today (I'm not at work because I can't get out of our driveway at home!!) The snow is so heavy still and it's a foot deep!

    Good luck hunny! I really wish you well. I too would fight the decision as it is something you are so enthusiastic about doing. Set out to prove to everyone that looking after 3 children will have no impact on the other residents and if that doesn't work tell them you will just have 10 of your own and make their lives hell
