It really does sound as if they don't understand. She was wrong not to bring it up you must get to the Chairperson. No other person or organisation is going to be able to sort this out. You really need to get to them first. No one else can make decisions about the lease and its conditions.I'm afraid.

If you are going to meet with the chair person, or who ever, Why don't you do a presentation about what childminding is about, Show them your your plans and policies. you could stress that a part of the EYFS is that we should get the children outside each day, so infact you wont be in all the time.

I'd also like to ask them what is the difference between you having 3 children of your own, who would be there 24/7 and you minding 3 children, who would go home in the evening, hence not disturbing the other residence.

With all these posts I'm sure there will be plenty of ideas for a presentation!!

Anyhow good luck and I'm glad you are continuing with your course.

Although it might take years to throw you out you have to consider whether it would affect your childminding insurance if you just did it anyway - would it be considered that you were minding illegally and therefore make it invalid? Just a thought, might be worth checking before doing anything rash.

Grrr! I've just had a very snotty email from the guy at the management company who works on behalf of the freeholders! He's basically told them they can't let me childmind because of the lease....he then said...

'The fact that 3 ( I have 2 young children in child care and am very aware of what it entails) children will be looked after and the noise and H&S aspects are an important consideration, the overriding factor is the terms of the lease and we have advised the board that this point needs to be upheld.'

How dare he!? It's no different from looking after 3 children of my own and OFSTED would come and inspect the stairs etc for H & S issues! He then went on to say you really should have consulted your lease before you looked into this no businesses are allowed and we can't be seen to be selective.

We'll see about that - i WILL keep fighting, how dare he!

Started a reply some hours ago but S and I got overpowered by tiredness .

Anyhow, what I was going to say was get hold of the planning dept and see how your area classifies childminding. If less than 6 children doesn't qualify as a business than I would go ahead and register etc etc.

If your leaseholder finds out, and kicks up a fuss, and you are a member of NCMA you'll be entitled to legal help from them too.

    Hope you get it sorted

    xx
