Default Bit of a silly question...

Mum of mindee got married on Saturday, on all our contracts it has her maiden name, and now obviously, that has changed. Do I need to amend all the documents with her name on?

Can I just score her old name and write her knew name and get us both to sign it? Do I need to do new contracts? Or can I just leave it as is?

I'm pretty sure you can leave it as it is.

Personally I'd ask for a copy of her marriage certificate and just add it to the child's file. That way, in future you can document in her married name but you have evidence of a legal name change without having to change your existing paperwork

I would do new Contracts and get both of them to sign them. They are then both responsible to pay if anything goes wrong. It is good practice to review Contracts when there is a significant change and the marriage of a parent is that. Personally I would also renew any other paperwork she has signed and get both of them to sign so it is all up to date.

I don't think I would dream of asking to see the marriage certificate, unless you doubt what she is saying and I certainly wouldn't copy and keep it, it is a personal document to them not for me.

Do you know if she is changing her name? Not everyone does

I have a couple of mothers who regularly forget what their married names are and sign registers etc with their maiden names, sometimes the bank accounts they pay from are in maiden names too, so it can be hard to check who has paid on the bank statements.

I still have my passport and some utility bills in my maiden name! I wouldn't worry about doing new contracts now. Maybe staple a bit of paper with her married name and the date it changed to the contract. Then when you do a contract review update it

Why don't you just ask mom, see what she prefers?

I'm no legal eagle, so I suppose you may want to seek advice about the legal aspect, if anything in the future was to be disputed, would it make your contracts invalid? I don't know the answer to that...

Please keep us posted, it would be useful to know! X

Just to further add...it's good practice to review your documents and policies every 6months anyway, so perhaps when you next do that just bring it up! X
