Default PACEY/NCMA CONTRACTS - please let this be the last post on this subject

"The PACEY 24/7 Legal Advice Line, manned by Solicitors, is available to advise you on how best to recover your debt. If the best solution is to take legal action against the parent, then provided you are a member and use PACEY's up-to-date Contracts which have been drafted by Solicitors to ensure a formal agreement between you and the parent that supports your interests in every way, PACEY's legal expenses insurance will pay for your legal costs to advise you throughout the process and use the full force of the Courts to help recover your debt. Our Legal Advice Line will still help you with practical advice over the telephone even if you prefer not to use our Contracts. Please refer to the member's area and the legal advice section for further details."

Our members can use older contracts and still receive the legal expenses benefit, the point trying to be made was that we are constantly reviewing the contracts on feedback from cases brought to the solicitors. This ensures the best chance of the childminder succeeding in court. The quote on older contracts that may not stand up in court is due to cases being challenged and law changing ,sometimes the slightest of change, thus requiring us to update the contracts we sell to members.

We will always advise that our members should be using the best, most up to date products for their business and as such the most up to date paperwork, but, I stress it's not compulsory as we do not have any expiry dates on the products. The legal team will still do all they can to ensure a positive result for the member.

I will investigate who the member spoke to and make sure they are clear on the above.

I hope this clarifies everything and I especially like the last sentence which shows that they do care about their members and their staff.

It would seem though that by the original post being shared and discussed that now everyone has an answer in black and white (and even red & blue), I hope PACEY improves their staff training if it turns out to be the cause of the original confusion. Thank you for getting to the bottom of this.
