omg please help!!!
i am now more confused after speaking to ofsted about a variation i applied for! ok bare with me i wll try to explain...

ok i have 3 of my own children 6, 4 and under 1. i want to start a new contract from septmeber to take on 4 year old and 2 year old.
at the momnet i am onlg reg'd for 4 children so applied for a vairiation to increase my numbers to the maximum (6).
i also would have 4 of the children under the age of 5, however my own 4 year old will be in full time education and the 4 year old i take on will also be in full time education.
but ofsted said i would have to apply again in sep to change my own 4 year old to not be included in the ey age group?? so basically i cant take on these 2 children? i have to take just one and then apply to take the other 1 on?

but i said that didnt make sense and she then said 'oh if the 4 year old minded child is in full time education she wont be in the ey age group??

so now i am soooo confused?? can i take them on or not? basically my certificate will say i can take on 3 more children, 1 only being in the ey age group?

please help

You need to have the 'rising 5' clause on your certificate meaning that if a child is age 4 and in full time education you can class then within your 5-8 yr old ratio - meaning they will free up an under 5 space.

So providing you have that clause on your certificate you can take on the other children as ;

your 4 year old and the minded 4 yr old will be in your 5-8 bracket along with your 6 year old - that is ALL your spaces taken for 5-8's

and you will have your own 1yr old and the minded 2 yr old meaning you have 1 space free in under 5's ratios.


Just to confuzzle you more... you can 'float' a rising 5 between the two age groups to suit your convienence! so technically one of the rising 5 4yr olds could be dropped back down into the under 5 group freeing up a space in yoru over 5's iyswim.
just make sure that when they turn 5 you have enough space for them in the 5-8 group

she basically said my certificate would say 'can have 3 children, 1 in the ey age ground.

so when it comes would i need to change it again for the condition to be put on? even before my contract starts?
