I have just checked wording in Stat Guidance and it says "at any one time, childminders may care for a maximum of six children UNDER the age of eight. So no this child is not included in your ratios.

I'm not sure as you are in Wales so might be different

I'm in Wales - Once a child has their 8th birthday they are out of our ratios :) (at the moment, it may change as they consulted on extending the ratios in Wales to include up to 12 years but will probably be 10 under 12)
