Hi, Can anybody help here or give advice regarding ratios.

I have 2 children of my own aged 2 and 3. On the days they go to nursery I have been told I still need to include them in my ratios. This means I can only mind 1 child under 5 until my 3 year old goes to school.

Surely if they are at nursery (8am - 6pm) then they are automatically NOT in my ratios??:panic:

Any help would be greatly appreciated.

I'm afraid they ARE still in your numbers. What happens if they are returned to you during the day due to sickness. You will be over your numbers. They become out of your numbers when they are in full time school, not nursery I'm afraid

Absolutely, this is correct. You must count your own old children wherever they are.

Unless you're in Scotland, where my certificate states I'm only allowed 6 under 16 years, not 8 years. Which I think is a bit stupid as if you have a 15 year old child then that would mean they still come into your numbers?! :confused:

I don't think many people know this as there are a few local minders who I know have clearly been over their numbers when their child is 'elsewhere'.

I don't have any children of my own, but I can see the reasoning behind it, but it could potentially restrict your earnings quite severely! It would be harsh if you had twins of school age!

Yeah my 11 year old and 7 year old both count in my 6 xx

Thanks guys, appreciate you quick replies and support. This has really knocked me, but I am thinking of getting an assistant. I have the required floor space and would also keep me within my numbers.

Sorry to butt in......i have a 8m mindie, 1yr (my own) a 2yr (my own) nearly 3yr mindie and a 6yr (again my own)......the nearly 3yr and 8m are sisters......does this mean im over my limit :/

Were you already caring for the 3 year old before you cared for the baby? Or did they start together?

If you have 1 year your own, 2 year your own and a 6 year your own you only have 1 under 5 space. If you have taken on an 8mth and 3 year then you are over your numbers and changes are you will get an inadequate at your inspection because it was new business.

If this has happened, my advice would be to do a risk assessment and talk to Ofsted annonymously and ask their advice. They may send you back to the EYFS though.

If you already had the 3 year old and then the baby came along you are fine under continuity of care. Just make sure you follow the eyfs on variations and do your risk assessments etc and it is fine

Hi I've got a similar situation. Have agreed to mind a three year old one day a week and mum is now asking me to have the one year old as the nana can't have her. I also mind a one year old and my own three year old. Both 3 year olds go morning pre-school. So I would end up having 4 under 5's for about 5 hrs one day a week. Am I allowed to do thus ... Seen something in revised eyfs about sibling babies just wanted to double check. Will of course risk assess. I have one other under 8 so I'd be within the 6 under 8 ratio.

Unless I read it wrong this is a straightforward variation with continuity of care and the EYFS...both 2012 and now 2014....are very clear on that as variations have been the same since 2012

Make sure you do a very good RA on your equipment, resources and you are able to demonstrate and also explain that you can meet all individual needs

Hi, Yes this is right. You do have to include your own children in your numbers. You have to take into account when children are on school holidays xx
