Hi there,

Am I allowed (with written permisson from parents) to take and send a photo(via text) with their child only in the photo??

With all the rumpus with the nursery recently not sure?

Hi, yes that's fine to do. I regularly keep mum up to date with pictures on whatsapp. Especially if the child had been upset that morning and mum needs reassurance.

I think the issue in the nursery was that the person in question was using her personal phone when it should have been a business one? ( That rule wouldn't apply to a Childminder since we operate on our own)

As Kaybeaa has already said yes with written permission. I also use WhatsApp a lot. I also send little video recordings.

We all need to be registered with ICO as data handlers - www.ico.gov.uk.

Then yes we can use apps like Whatapp (I've spoken to ICO and they are fine with it) as long as we take all reasonable care to ensure information about the child and their parents is stored and deleted securely.

It is very good practice to ask parents permission first as well.
