    Default Assistants Wages

    I'm taking on an assistant who will be self employed.

    My question is, do I set her rate per day or do I legally have to pay her NMW?

    If assistant is self employed as far as I'm aware there is no nmw... I know a cm and assistant and cm set the daily rate ... If assistant off for a few hours she works out what it would be per hour and detucts that from earnings

    I don't honestly know the answer, but I do know that HMRC and other bodies are getting very watchful of self-employment being used as a way of avoiding tax and giving workers their proper rights. There have been numerous investigations into cases where the self-employed person might reasonably be expected to be an employed person IYSWIM.

    Worth taking legal advice on this one - or check with your professional representative body/insurer.

    There is a list of requirements of being self-employed https://www.gov.uk/working-for-yours...-self-employed

    I know that if a family take on a nanny as self employed and she doesn't fit the requirements then the family can be fined for trying to avoid paying tax etc. As bunyip says- seek further advice.
