    Question Parental Responsibility

    Hi there!!!

I have a form which I give to parents to sign for Parental Responsibility, one of my mums has said that her ex husband has joint parental control but does not want to be the contact in case of any problems and can she just put her mum down instead?

I'm confused, can she put her mum down?

You need to know who has PR so that if they come to collect the child or are involved in signing paperwork you know they are legally ok.

Parents should then give you 3 emergency contacts, usually in order of the distance they live if they have to come and collect the child in an emergency situation.

They do not have to be the same person as the one who has PR.

However mum needs to understand that if dad has PR and he comes to collect his child from you, you do not have a legal right to withhold the child unless there is a court order in place.

you can ring the mum and say xx is here to collect, you didn't tell me they were coming, I need to check it is ok with you... but you cannot legally stop them leaving.

    Default Parental Responsibility

Thank you, that does help a lot!

I've used the form from here so can she put her name and the name of her mum? Also should I explain to her that if her ex did come to pick their child up then there would be nothing I could do to stop him? But I would obviously ring her first considering I would have no idea who he was!

This is probably really simple, but for some reason I can't seem to get my head round it!
