    Default Boyfriend with criminal record

    Hi, I just wanted to ask a question, a friend of mine has a boyfriend (doesnt live with her) who has a criminal record, one about 10 years ago and the last one about 18 months ago for common assault (nothing to do with children) , how does this work with childminding, could she have him crb checked and Ofsted decide if he can be around when she childminds or is it a total no go? and also if things progress would she be allowed to childmind if he lived there?

    My friend isn't registered as yet, hence why I'm asking the questions for her and she wanted to check before she does completes her registration!!!

    Ofsted treat each case on its own merits so nobody can advise you for sure.

    The truth is its all down to individual inspectors decision.

    I've read (on here) that crimes against children or violent crimes and will look at when they happened (18mths is fairly recent)

    doesnt look good but he doesnt live with her and he doesnt visit during minding time then i prob wouldnt get him checked yet. you only have to if they work or live in the house or frequent visitor. cross the bridge when they come to it about him moving in altough they might say he must be out the house.

    A friend of mine who no longer minds had a similar situation it was hubby and living in the house - it did take slightly longer to register and has I remember ofsted came out and saw her and hubby pre-reg but it was fine - similar offences too.

    I have to say as a parent I would be happy with my child being there if he is violent, and if it was only 18 months ago then everyone local will almost certainly remember him being charged.

    mm It's what I thought....I did say to her that unless he is living there he shouldn't need to be crb checked, and I haven't seen him there apart from once in childminding hours, however obviously it would be different if he were to move in.

    Thanks for all of your reponses, I shall let her know and give her Ofsteds number.

    I my self have just had this problem, Ofsted have just passed hubby's crb, hubby knew he had convictions, common assault (one was arm hit someones face who was trying to hold him and the other was for spitting in someones face, both while drunk but looks aweful when you receive the crb!) and abusive threatening behaviour.

    Although these were over 7 years ago now. I would say phone ofsted b4 like i did then see what they say.

    I nearly wasn't going to do childminding because i thought people wouldn't want my hubby around there children. However ofsted did follow up my hubby's crb and made sure he was ok. I see it as ofsted have approved us both.

    My partner also have a criminal record and the ofsted women said it shouldn't stop me unless its against they only say a definite no if the person had any offense against vulnerable adults or children!!

    so not to worry in other words... his are also for fighting, drunk and disordley, breach of the peace hes never been done for assult or gbh tho or anything like that tho??!!! one only 3 years ago... he has only ever be fined for them she said its not to bad if he hasn't been to prision, which he never has hes only ever had fines... all you can do like she said was wait for when they receive it and if his did get refused for it you can appeal and she said they hardly ever decline a person when it goes to an appeal??

    she can just try and see what they say??? Like they say they base them on individual cases.

    It is my understanding that CRB's are looked at from a person being with a child. Just because a person has had a few blows in the past doesn't mean they will not get this type of CRB passed.

    Well no I wouldn't either, but people need to work so I take my hat off to my friend for finding out and doing the right thing, how many child minders are out there that don't declare that their boyfriend visits or is living with them and parents have no idea of their partners background?

    Common assault : Both in the common law and under statute, the actus reus of a common assault is committed when one person causes another to apprehend or fear that force is about to be used to cause some degree of personal contact and possible injury.

    There are possibilitys as to why these are on his record! I understand others peoples opinions but I find them a bit unfair as to say because they have common assault on there crb, that makes them violent.

    All the best to your friend! She will need to state his convictions on the appliction anyway. If she doesn't they will see this as not being honest. I feel for her i really do, but i feel she is being honest to get her boyfriend crb'd as he is round the children.
