Default 2 under 1's from September

    help!

Bit confussed, are the new regulations regarding having 2 under 1's actually happening in September?

I have 2 parents wanting spaces, and they will overlap 2 days a week for 3 hours, for 1 month, until the eldest turns 1.

Am I allowed to do this or not?

I have the younger one's sister before and after school

The change to ratios from September was 'thrown out' by Clegg etc - we have to stay within current eyfs guidelines.

If I call Ofsted might they grant me permission? Sorry I am still fairly new and trying to get my head round things and I haven't come across this before

If it is new business u cannot have a variation.

Do u already care for the child that is not mindees sibling? If so u can have a variation for continuity of care for the sibling.

Ofsted used to grant variations for new business when it was on certificate. They did for me. I would say no under the guidelines but would contact them and see what they say

There is a week difference in start dates, with new business starting first

Personally I would say you know the sibling is starting so that is your under 1 place gone.

Sorry the other is new business regardless when they start.
When someone tells you nothing is impossible, tell them to go slam a revolving door

That was what I thought would be most likely.

Will speak to Ofsted. My mum might have to be my assistant ( and complete relevant hoops!) to cover it

There is a long time between now and September and plans may change for either family, so I would not be turning anyone away.
I would tell mum of siblings that you will be able to offer the place but not in writing until the other child has started and explain the new business situation.

Obviously risk assess and look carefully at how you will provide for all lo's needs at all times during the overlaps and be sure it is safe and not too stressful before you talk to her

I spoke to Ofsted and they are happy for me to have both for such a short period of time so long as parents give permission and I risk assess it

Well I rang Ofsted last month and asked the exact same question and they told me in no uncertain terms that I was NOT allowed to do it, despite having a variation for 2 under ones on my certificate before the changes. I am currently paying someone £6.20 an hour for 2 mornings a week until the eldest one turns 1 at the end of the month. I would be very careful if I were you and make a note of the name of the person you spoke to and the date and time of the call in case its ever questioned. I do wish they would be consistent.

I always write down who I spoke to and when.

They are such a pain aren't they!
