When does a late finish become overnight care?

I've had an enquiry for a toddler for a temporary two week contract, to be cared for in the evenings until about midnight when they will be picked up. (Mum is perfoming in a local show). The child would be hypothetically be asleep upstairs in a cot for most of this.

This doesn't count as overnight care, does it?

I would check with ofsted, but I thought overnight care only counted if you actually went to bed. So as long as you are awake, it's not overnight. I wouldn't have thought minding until midnight would count as overnight.

I think I read (but can't quite remember!) that overnight is where you spend the most hours from 8pm until 6 am. So 8pm til 12am wouldn't be overnight as LO would then have 6 hours with mum. Best check though, it's quite early on a sunday!
