And what do you do if you know that a creche is employing people who aren't?

If a provision is registered with Ofsted then everyone needs to have a CRB check - even the cleaner if they are there at the same time as children.
If they are not registered - if children attend for less than 2 hours a day - then the rules are different.
If you are unsure I suggest you contact Ofsted for more guidance - 0300 123 1231.
If you are concerned about someone working with children and you feel there are reasons why they shouldn't be there then you should contact the Local Safeguarding Children Board / Child Protection Agency or the Police.
