Is it legal to go ahead and say advertise

"kindergarden tots childminding"

Or is there an actual legal route you need to go through with a solicitor etc to make sure the name isn't already taken t avoid copyrighting and things?

As a sole trader you can choose any name you like but they do recommend that you consider local businesses names before choosing, for your own sake as well as theirs, to avoid confusion. Plus you must not use a name already registered by a company or as a trademark.
