Has anyone applied for a variation to mind 4 over 5's? In january 2011 when 2 under 5 children class as 5 , i will have 4 over 5's do ofsted grant this? or will one have to move, one child has a older sibling in the older bracket, so i dont know if they will on contunity of care?

They will only allow 6 under 8 (inc. any of your own), they may grant a variation for continuity of care for 4 under 5's ie. 4 under 5 - 2 more (totally 6) under 8. Is that what you're asking - once the 4/5 year olds are in school full time they fall into the older bracket if your certificate says so? Clear as mud?

You don't need a variation for over 5's providing you are still in your numbers, it's only usually for under 5's. So if you are reg for 6 children and you have 5 over 5's you could then only have 1 under. Or you could have 6 over 5 but no under's. How many under 5 will you have with the 4 overs?

i will have one child under 5, who will be 4 in preschool (my daughter)
so will have 2x4 yr olds in reception who count as 5, and 2x6yr olds.
so iam within my numbers so your saying i dont need a variation? just wanted to know as didnt wana let anyone down.

If I have read your post right you will have 5 children under 8. If your certificate says you are allowed 6 children under the age of 8 (the maximum anyone can have) then you still have a free space anyway for another child. You don't need a variation as you are within your numbers.:)
