Husband as Assistant

I just wondered if I register my husband as my assistant do you think I would be allowed to increase my numbers to 4 under 5's? I only need it to cover about 45mins twice a week whilst I do a nursery pick up as mum can't get to me any earlier for one mindee.

I was thinking that if I register DH as an assistant I could increase my numbers and leave our DD at home with him so I have the mindee's with me and I'm still not looking after more than three at a time.

Do you think they'll agree to this??? If not I'm going to have to rearrange my whole day and try and get mum to pick mindee up from the nursery.
