This is the information you need if you are unsure of what to do if someone has swine flu in your setting


Childcare providers reporting outbreaks of Flu virus H1N1 (Swine flu)


Providers are only required to tell Ofsted about outbreaks of food poisoning or any notifiable disease (as set out in the Public Health (Infectious Diseases) Regulations 1988).

Swine flu is not listed as a notifiable disease and so providers are not required to inform Ofsted about any outbreaks of flu on the premises.

The EYFS statutory framework requires providers to discuss with parents the procedure for any children who are ill or infectious. In addition, providers must meet the adult: child ratios set out in the EYFS statutory framework at all times, including ensuring that there are sufficient staff available to cover staff breaks, holidays and sickness. ( If you have an assistant )

It is the provider’s responsibility as to how they manage an outbreak of flu amongst children in a setting, for example by being clear with parents about whether or not they will admit a child who is suffering from swine flu. In addition, providers will need to ensure that where staff are off sick, they make alternative arrangements to ensure that the appropriate ratios continue to be met at all times.

Providers who need further support or advice as to how they can continue to meet the EYFS requirements during an outbreak of swine flu should contact their local authority for advice.
