View Full Version : need some advice please. Do you need to see proof of self employment

Hi
Im taking on assistant and she is classing her self for self employed.
Do i need to see proof that shes classed her as self employed (tax form or UTL number) as she will be paying her nation insurance and tax.
I Have got a contract which does say that she is responcable for tax and NI is that enough.

I would say that it is her responsibility.

If you are not sure, you should contact the tax office for advice. I've always found them helpful :D

If you contact he IR you can ask for a pack that explains employing someone

As long as you have an invoice and you pay it the legalities lie with your assistant to declare earnings.

I used to run an after school club and our accountant said that the best thing to do was have them sign a declaration that they would be responsible for their own tax etc. This is obviously only applicable for people who are earning below the taxable limit in your employment. If they have another job elsewhere you may need to take that in to account and get them to complete a P46 form for the tax office who will then advise you.
