I don't really understand the assistant part?

We don't want more children, but what more could he do?

I think an assistant can only be left unsupervised (or have sole care) if they have done 1st Aid training, Ofsted agree and you have written parental consent and only for the Early Years age 0-5. I'm not sure if leaving the room counts, but it's worth talking to Ofsted about it, they'll be able to confirm what can/can't be done. I think

In case he's not registered as your assistant yet, applying is easy using EY2 form and they need enhanced CRB. I imagine you already have that in place if you're already registered, so it will probably be even easier to arrange.
