Can anyone help me I don't know who to payto be able to take photos of my children in my care

If you are using a digital device (camera/phone) you need to register as a data controller with the ICO https://ico.org.uk/

If you are using an old fashioned camera with film and not storing any other data on a computer or digital device you do not need to register. If you store any data on a computer you do need to register and if you take a photo, immediately print out and delete you still need to register as you have processed data.

It is not just on a computer, it is about handling data in whatever format.

Moggy is right.

CMs come under the Data Protection Act very easily, whether or not we use a computer.

For one thing, if you so much as store a client's 'phone number in your mobile 'phone, that's digitally-held data.

Data Protection Act 1998 (DPA) generally applies only to personal data held digitally (computer, etc.) but also to paper documentation held within what it calls a "relevant filing system". The latter could include a business diary or address book, making the CM a 'data handler' under the ICO's terms of reference.

Somewhere in the mists of time, a trainer or DO mentioned something along the lines of "CMs need to register with ICO even if we only use a digital camera." Somehow this got twisted and misinterpreted as if it meant "you don't need to register with ICO unless you use a digital camera." :p
