Can a childminding assistant be self employed or does the childminder have to employ them

i 'think' its down to the assistant...

when i had an assistant, she was self employed, because she only worked a couple of afternoons for me, and was free to look for other work at other times ( she cared for an elderly neighbour, and also worked in a gallery! ). she would invoice me at the end of the month for all hours worked that month. i left it to her to deal with her tax/national insurance etc.

but, if your assistant works full time with you, or over a set number of hours, then you employ them and you are responsible for paying their tax, NI and possibly holiday & sickness pay. there are lots of people on the forum who employ fulltime assitants, so i'm sure someone else will give you a clearer idea!

I think most child minders use the self employed system. Works fine

As long as they are free to look for work elsewhere they can be self employed
