hi can someine just confirm im right or if ive gone completely la la. Taken on 3yr old twin girls but just been asked if i can have a 1yr old (2 in feb). My numbers were 2 under 5 + 2 over 5 because i have a 4yr old and a 7yr old of my own. Would i be able to take on the 1yr old under the new rules?? My 4yr old would only be there for half an hr b4 going to school and 2hrs after?? Altogether on that day i would have 4 under 5 (but not all day) and 1 7yr old???. Sorry hope this makes sense going round in circles here!

I'm no expert but you can't take on additional work if it puts you over the 3 under 5's but think as your daughter is a rising 5 and at school she would count in the 5-8 band. Therefore you would be able to take on the new work.

I'm sure someone more qualified will clarify the rules.

So assuming you are in England the rules are:
3 under 5 and 3 aged 5-8
Children attending school aged 4 and in full time education mon-fri all day are counted in the 5-8 year old bracket

So you can have the twins and the nearly 2 plus your 4 year old reception aged child and your seven year old.
