View Full Version : How many children can I have under the new regulations

Hi all
I have agreed to mind a 15month old boy along side my 2 year old. However I have just been asked to mind a 5month old and a 4 year old also. So that would be 4 under 5s altogether. The 15month old would be term time only.
I know OFSTED are not stipulating numbers now but I dont if they would see it as too many. I have a large space for the children and am an experienced early years teacher so think it would be hard but I could do it.
What do you all think?

It remains 3 under 5 (including your own) but you can go over this for continuity of care or for own or sibling babies. I'm sure it's not 'allowed' for new business.

Is the 4 year old in full time school - requiring only before and after school or holiday care?

If yes then you can do it as the 4 year old is classed as 5 for your ratios.

HOWEVER if the 4 year old is not at school you cannot go over 3 under 5 unless it is in exceptional circumstances for continuity of care - as explained in the EYFS.

Unfortunately the rules say you cannot take on an extra under 5 for new business...
